To file a consumer complaint in India, it is first important to establish a valid ground for filing a consumer complaint. A consumer complaint can be filed in the following cases: When the goods sold are defective or damaged. When the services provided are deficient or not as promised. When the seller or service provider follows restrictive trade practice. When the seller or service provider follows unfair trade practice. A complaint in a consumer court can be filed by anyone who is considered as a customer under Section 12 of the Consumer Protection Act, 1986. It states that: A complaint in relation to any goods sold or delivered or agreed to be sold or delivered or any service provided or agreed to be provided may be filed by- the consumer to whom such goods are sold or delivered or agreed to be sold or delivered or such service provided or agreed to be provided; any recognized consumer association whether the consumer to whom the goods sold or delivered or agreed to be sold or delivered or service provided or agreed to be provided is a member of such association or not; one or more consumers, where there are numerous consumers having the same interest, with the permission of the District Forum, on behalf of, or for the benefit of, all consumers so interested; or the Central or the State Government. Process to file a consumer complaint in a consumer court in India A legal notice needs to be sent to the seller or service provider, as the case may be. You need to first send a consumer complaint notice through a consumer case lawyer in India to the concerned company informing them about your grievance. After you send a legal notice, you need to wait for the given notice period (usually 30 days) before you file a complaint with the consumer forum. The consumer forums in India are as follows: District Consumer Dispute Redressal Forum: The value of the goods or services and the compensation does not exceed Rs. 20 lakhs. State Consumer Dispute Redressal Commission: The value of the goods or services and compensation is more than Rs. 20 lakhs but less than Rs. 1 crore as well as appeals against the orders of any District Forum within the State. National Consumer Dispute Redressal Commission: The value of the goods or services and compensation is more than Rs. 1 crore; as well as appeals against the orders of any State Commission. The consumer protection lawyer in India will draft your complaint along with the prescribed fees and supporting documents. Once the court is convinced that a case lies against the seller or service provider, the court calls the other party to the court and represent their side. During the process, evidence, witnesses and samples of the product are taken into consideration to establish the fault of the seller.  You can also read How To File A Consumer Complaint In Consumer Forum in India?Read More
