A class action against a builder is a complaint filed by a group of homebuyers who have the same interest or grievance and seek the same relief from the builder. As per Section 12(1)(c), one or more consumers, where there are numerous consumers having the same interest, with the permission of the District Forum, can file a single complaint in the appropriate consumer forum. In real estate matters, homebuyers, therefore, have the option to combine their complaint and directly approach the NCDRC when their claim exceeds INR 1 Crore.  It is advised to consult a good property lawyer in India to establish whether the homebuyers have a valid claim before proceeding with a complaint. However, the following conditions must be met to file a group complaint in NCDRC against a builder: All the buyers have the same grievance. All the homebuyers seek the same relief.
