Validity Of Property Transfer By Mother Under Muslim Law When In Possession Of Son
A Muslim mother gave a house to her 3 daughters as settlement. The house was under the absolute possession of her son. Is this valid?
- Sector-1, Noida
A Muslim mother is entitled to inherit from her children, if they are independent. She is eligible to inherit one-sixth of her dead child's property if her son is a father as well. In the absence of grandchildren, she would get the one-third share. There are other provisions, too, in the law which ensure financial security of a Muslim woman.
