My wife and I are living together. She earns but that is 1/5th of my salary. Due to frequent arguments and insulting behaviours in the public domain also it has become almost intolerable on my part to continue this relationship. She is also not happy with this relationship but does not want any mutual divorce. We are married for three years now. Do not have any children. She is also not interested in having children as such. In this case, how can I file for contested divorce? What may be the maximum alimony that I have to give? I have dependent parents also.

I suggest you to file a contesting Petition before the jurisdictional family court against your wife if she does not agree for a mutual divorce. Also, I suggest you to work on the possible settlement in view of minor child. Contact your advocate for more details and suggestion.

In India now adultery is free from the criminal offence. But still if one partner is having any kind of physical relationship outside the marriage then in that case husband can apply for the divorce petition in the court
