Am writing from Nigeria, I engaged an Indian Software company to develop a mobile app. We agreed on scope, specifications, cost, timelines and even signed a binding agreement with a penalty clause for failure to deliver. This company could not deliver on the agreed timeline. More than 10 days after the timeline has been exhausted and this software company has not still delivered. We even offer to get more hands for the company, at our own cost, so they can deliver and allow us to use the work for it intended purpose as our final user of the project has given us several graces and extensions which we have not been able to meet. This resolution was rejected by the company rather they offered to abandon the work and send us the incomplete work they have done so we can source for a solution without their collaboration. I need proper legal advice and representation on how to deal with this situation. I will provide the agreement we signed on request.
