I had booked a flat, which, due to a financial issue, I had to cancel. At the time of booking, I had given INR 1 lac which now the builder says, is forfeited. Builder buyer agreement has not taken place till now, and they have just allotted a unit to me. They say the form clearly mention that 10% of the price will be forfeited in case of cancellation. What can be done?

The builder has no right to forfeit the given amount as a cancellation amount as no agreement has taken place. In case a developer refuses to repay the booking amount even with a clause present in the agreement, the buyer may file a case with the consumer forum asking for a refund with interest. If the property is registered in RERA, the homebuyer can file a RERA Complaint.
