Can an email be used as an agreement / legal document in court?

Yes, emails and other electronic documents are admissible as evidence in courts in India and may be used in formation of contracts.Changes have been made to the Indian Evidence Act, 1872 ('Evidence Act') specifically to address this. The definition of the term 'evidence' itself in Section 3 of the Evidence Act has been amended to include electronic records. it is possible to present email as an evidence in a court of law, by taking a printout of the email on a paper. However, such email should normally be accompanied by an affidavit made by the person who was responsible for operating the machine and must meet the following criteria mentioned under section 65B of the Evidence Act.
