For your matter, it is advised to send a legal notice to the ISP before you proceed to file a complaint with the consumer court as a legal notice drafted by a good consumer court lawyer in India will be very effective and make the company refund your amount. In case the company does not resolve your matter or fails to send a reply to the legal notice, you can proceed to hire a consumer protection lawyer and file a complaint with the district consumer court of the area where you reside.

You must send a legal notice to the Internet Service Provider even if you plan to file a consumer complaint as it is mandatory to send a legal notice to the service provider before you take a legal action against it before the consumer forum under the Consumer Protection Act.
