I was working in a Pvt. ltd. Company. I worked for more then 7 years in this company. I resigned on 15 March 2018 and served 45 days notice period as per company rule. On 15 April 2018 there was a change in salary structure. My Basic salary became about 16500 from near about 25800. I got my last salary on 1 April with 24973 (Basic salary). My Full and Final amount will be given on 1st week of June 2018. My Questions are: Will the company calculate my gratuity according to March 2018 month on the day I resigned Or on the basis of April salary slip (Which is my full 7 final amount). By law which is my last salary for gratuity calculation? Is it OK for the company to lower the basic salary to such low amount? Can you help me to get right amount if they give me less gratuity amount than what I should get?

Gratuity is a sum of money paid by an employer to an employee for services rendered in the company. It is paid only to employees who complete 5 or more years with the company.

Eligibiliy Criteria for Gratuity:

  1. An employee should be eligible for superannuation
  2. An employee retires
  3. An employee resigns after working for 5 years with a single employer
  4. An employee passes away or suffers disability due to illness or accident.

You can consult an employment lawyer to know about the amount that must be paid to you by your company in form of gratuity.
