As per Sales agreement if the increase in area is within +- 3 % ,then neither builder nor client will raise any demand,However, if the increase in super built up area is more than + 3 % and client does not give consent then builder to return entire money after cancelling the flat without any deduction along with accrued interest@10% . Since the increase in Super built area is 10% which is more than 3%. I have not accepted it and requested builder to refund my entire money as per sales agreement clause stated above. For more than two months, I am following up with the builder. I want to take up my case with UP RERA. Please advice.

Since your sale agreement lays down the provision of refund of money in this particular situation, you can hire a good property lawyer in India to send a legal notice to the builder to refund your money, and if he does not reply, file a RERA complaint. Call us at 011-33138123 or send us an email at contact@legistify.com to get started.
