The guardianship has been defined in the Guardianship and Wards Act, “That a person having the care of the person of a minor or of his property or of both person and property.” The meaning of guardianship is that a guardianship of a minor. But there is no mention of disposal in marriage in any part of the Act and nothing to indicate that it was intended to interfere with the rules of Muslim Law. The Quran is the basis of law relating to guardianship which assigns that function under name of ‘jabar’ entitled to care and custody of the (hiznat) ward’s person (Wilson).
