In order to protect your idea and code, your software developer needs to enter into a non disclosure agreement. A non disclosure agreement is an agreement between two or more parties that outlines confidential material, knowledge, or information that the parties wish to share with one another for certain purposes, but wish to restrict access to or by third parties. The parties agree not to share the information covered in the non disclosure agreement with any third party.

In the present case, the non disclosure agreement that you enter into with the software developer must state the information you wish to protect. Along with the confidential information other information such as what all is excluded from confidential information, obligations of the receiving party, etc. must also be mentioned.
