Kathua Case: Supreme Court Ready to Take up the Case

The Supreme Court has stated that it is ready to take a suo motu cognizance of the horrific case of gang-raping and murder of an 8-year-old girl Asifa, in Kathua village near Jammu.

Numerous lawyers of the Supreme court approached the apex court’s bench of CJI Dipak Misra, Justice A.M. Khanwilkar and Justice D.Y. Chandrachud to take suo motu cognisance of the ghastly incident that shook the incident.

The top court expressed that it was ready to take up the case, provided that the advocates present all facts of the case to the court in writing.

The apex court has asked the advocates to mention that lawyers in Kathua agitated and prevented a charge sheet to be filed against the accused persons and that these lawyers threatened the family of Asifa.

The police were prevented from filing a charge sheet against the men accused of the gang-rape and murder of 8-year-old Asifa in Kathua district of Jammu Kashmir.

In January, Asifa, who belongs to a nomad Muslim community was found murdered in the forests of Kathua. Asifa had been held captive, sedated and raped for several days at a Hindu temple by the temple custodian, his son and a police officer named Deepak Khajuria and 5 other men. She was murdered at Rassana village in Kathua district.

Investigations established that the atrocities against Asifa were allegedly meant to create horror among nomads and bakarwals and drive them out of the area.

An organization called the Hindu Ekta Manch was set up in opposition of the March against Asifa’s case and people in Kathua have reported that they were threatened and beaten up for showing condolences or support to Asifa’s family and the entire case.

Asifa’s case is one of the most horrendous cases that have taken place in the country that highlight how serious the problem of Jammu and Kashmir is, and how ugly politics can be.
