Delhi HC Issues Notice In Plea Against Alleged Violation Of RERA By DDA

Delhi high court on Wednesday issued a notice to Real Estate Development Authority and Delhi Development Authority (DDA) in public interest litigation (PIL) which alleged violation of statutory provisions of the Real Estate (Regulation and Development) Act, 2016 by the two bodies.

The petitioner alleged that DDA had not registered the “DDA Housing scheme 2017 and 2019" with the Real Estate Regulatory Authority, Delhi government and that is in contravention of the statutory rules and regulations under the Real Estate (Regulation and Development) Act, 2016.

“That the Delhi Development Authority has not provided the Real Estate Regulatory Authority, National Capital Territory of Delhi with any completion certificate, commencement certificate and occupancy certificate of the Real Estate Project ‘DDA Housing Scheme 2017 and 2019’," the petition said.

Petitioner Abhijit Mishra prayed for directions to the chairman of RERA and Delhi government to take appropriate disciplinary actions against the DDA and impose maximum penalty against it in accordance with the Act.

The petitioner also sought directions to the DDA to suspend the allotment process of the apartments under the project until it completes the formality of registration of the project with RERA.
