SC on Monday equated the right of a woman to give birth as part of her right to personal liberty and allowed a woman to abort her over 20-week-old foetus, which suffers from severe abnormalities, in a Kolkata hospital.
The law does not permit abortion, if a foetus is over 20 weeks old. Yet a Bench, led by Justice Dipak Misra, dictating the order in open court, highlighted the mental stress suffered by the woman who had approached the court for medical termination of her pregnancy.
Justice Misra observed in the order that the right of a woman to have a reproductive choice is the right of personal liberty.
Every woman has a sacrosanct right to bodily integrity, the court said.
On June 24, the court wanted to stretch the law on abortion that would allow termination of pregnancy beyond 20 weeks if the foetus is suffering from severe abnormalities.
