Bombay Lawyer's Association Move to SC Demanding Cross-Examination of Eleven Persons Related to the Controversy

Bombay Lawyers Association, one of the petitioners in the case relating to death of Judge Loya, has moved the Supreme Court seeking permission to cross-examine eleven persons connected to the controversy.

The petitioner has placed reliance on Constitution Bench decision of the Supreme Court in KK Kochunni v. State of Madras [1959 Supp (2) SCR 316] in which it was held that the Court may, in appropriate cases, be inclined to give opportunity to parties to establish their cases “by setting the application down for trial on evidence”.

The petitioner has also criticised the stand taken by the State of Maharashtra in the matter citing the fact that it has relied on a report of Sanjay Barve, DG/Commissioner without having filed the same on affidavit.
