Acquisition Proceedings to lapse under land Acquisition Act of 1894 if states do not take steps to complete the Proceedings: Allahabad High Court

In a recent order, the High Court of Allahabad has reiterated that acquisition proceedings initiated under the 1894 Land Acquisition Act would lapse in terms of Section 24 (2) of the 2013 Land Acquisition Act, if it is found that the State has not taken steps to complete the acquisition proceedings, even though an award was passed five or more years prior to the enforcement of the 2013 Act.

In this context, completion of acquisition proceedings would refer to transfer of physical possession of the land in question and payment of compensation by depositing the same in Court. If either of the two conditions are not satisfied, acquisition proceedings would not be complete, the Court ruled.

The petitioners in the case had approached the High Court to set aside acquisition proceedings initiated against their property under the Land Acquisition Act, 1894 (1894 Act).
