12 years on, 200 families to get legal ownership of flats

GURUGRAM: The 12-year-long wait of more than 200 families of The Residency Society in Ardee City in Sector 52 to get legal control over their flats is likely to end soon, with the Department of Town and Country Planning (DTCP) recently recommending the issuance of Occupancy certificate to the developer.

Buyers got possession and moved into their homes in The Residency in 2005, but the developer was unable to get the occupancy certificate, mandatory for registry of individual apartments, due to non-construction of flats meant for the economically weaker section (EWS). The developer had applied for the occupancy certificate in 2008.

According to DTCP officials, the developer was so far not given the occupancy certificate as the site for EWS flats "is under litigation". Now, district town planner RS Batth has recommended to the director of DTCP to issue the occupancy certificate as the builder has identified another site to construct EWS flats.

"The approval of the zonal plan for EWS flats at the new site is under process. The developer has assured to construct the EWS flats very soon and also requested for the issuance of occupancy certificate. We have also recommended for the same," Batth told TOI.

"As the matter pertains to the interest of public at large and had been raised by allottees at different platforms, the department has requested the head office to grant occupancy certificate to The Residency as the residents are residing in these flats without any legal sanctity," he added. The handover of maintenance of the society to RWA is also stuck due to the delay in granting of the occupancy certificate.

Residents say they are facing lot of problems in absence of occupancy certificate. "The developer is not taking care of the maintenance. Lifts are in bad shape and on many occasions, people got stuck in lifts," said Ritu Verma, vice president of RWA of The Residency. "Residents are also not able to sell their flats or take loan as they are not registered yet," said Verma, adding residents have been raising the issue for the past several years.

When contacted, a spokesperson for Ardee Infrastructure Limited, the developer, said, "The construction of EWS flats was delayed due to pending litigation on the land earmarked for it. Now we have identified a different site for EWS flats."

Spread over five acres of land, The Residency group housing society is part of Ardee City.
