Challenging the verdict, the petitioner alleged that the observation made by HC was uncalled for and it would have impact in deciding the appeal filed by the convicts in HC. "Any evidence of the character or previous sexual experience of the victim with any person is not relevant on the issue of consent or quality of consent in a trial for rape or sexual harassment case," the petition, filed through advocate Rohit Singh, said.
"The HC selectively extracted certain portion of her testimony to observe that she drank beer, engage in drugs and that condoms were found from her room during search in the university. The HC then relied upon the said portion, without looking at the explanations attached to them as stated by her, to adversely comment upon her character," the petition said.
A trail court court in Sonipat had in March awarded a 20-year sentence to Hardik and Karan each and a seven-year jail term to Vikas, holding them guilty of blackmailing and gang-raping the student of their university for around two years .
A complaint was lodged by the girl student to the university administration on April 11, 2015 , alleging that the trio, final year law students of the university, have been blackmailing and raping her since August 2013 . She also alleged that the accused were having her objectionable photos and they used to threaten her for making the photos viral. The victim alleged that she was was being blackmailed and forced to make physical relations with them.
