Nothing can be done to save and except to Partition the property whether it depreciate or appreciate the value of property. Partition can be done either by Partition Deed (registered) or through Court (Partition Suit).

If any property is eing transfered or sold fradulently then you have to file a suit for Declaration and Recovery of possession within 12 years from the date of knowldge. EIther of owner can file a suit but has to be authorised by other person. As per recent judgements older deeds will survive than later one. As there is no Lease Agreement therefore, it is tough to prove that it is lease agreement and taking such advantage he is now saying it is License.
