MCA Rules Regarding Company Name Availability
The Companies (Name Availability Rules), 2011 lay down the rules and guidelines regarding choosing a legally valid and acceptable company name. The name that does not follow these guidelines is not accepted by the MCA.
Unique Company Name
A new company's name must be unique and should not be identical with or resemble the name of a company in existence or a registered Trademark, or a Trademark for which an application has been pending under the Trade Marks Act, 1999.
Inappropriate Company Names
Any new business names that comprise of any generic words, adjectives, abbreviations, plurals, phonetic spellings, or spelling mistakes whether intentional or not are rejected.
Legally Acceptable Company Names
Under the MCA rules, the proposed company name must not be in violation of the Emblems and Names (Prevention of Improper Use) Act, 1950. The proposed business name must not be offensive to any section of people i.e. any ethinic group, religion, gender or heredity.
