How To Change Your Name Legally In India?

There are several reasons why you may need to change your name legally in India- you may need to change your name after marriage, or you may need to change name when you believe in numerology. Adding initials to the name, changing the last name or adding a letter or two in the name is common, but may people are not aware of the process of name changing in India.

Though changing your name seems rather easy, but when it comes to changing your name legally in India, it can be a complicated process as it involves numerous forms to be filled, publishing the name, etc.

Process To Change Your Name In India

The following steps are taken to change your name after marriage or for any other reason in India:

Affidavit In Court

The first formality to be fulfiled it to submit an affidavit to change your name. The affidavit is drafted on a stamp paper. The affidavit includes the following details:

  1. The existing name and the new name you wish to change it.
  2. The details relating to your address.
  3. The reason why you wish to change your name legally.

When you wish to change your name after marriage, the following details need to be provided in the affidavit: 

  1. Old name with details about the father’s address and name.
  2. New name with details about husband’s address and name.
  3. Date on which the marriage was solemnised.

The affidavit for the name change is signed and attested by two witnesses who are ranking gazetted officers. 

Publication In Newspaper

Once the affidavit is submitted, the next step to change your name legally in India is to get the name change published in a local newspaper through an advertisement or notification. The publication is to be made in the newspaper of English language and of the official language of the state in which you reside.

Notification In Gazette

After the notification of name change is published in local newspapers, you need to get the name change notified in the Official Gazette. The following documents need to be submitted to submit the notification in Gazette:

  1. Application form for changing the name.
  2. Letter of Declaration
  3. Copy of Advertisements
  4. Photographs
  5. ID proof
  6. Address Proof

These documents need to be submitted along with the prescribed fees. Once the documents are verified, the government will notify the name change in the Gazette. The documents relating to changing your name legally must be kept safely as these documents are needed in case of passport renewal, banking purposes, etc.

How To Change Your Name In PAN Car Or Aadhar Card?

The procedure to change your name or other details in the PAN card or Aadhar card are prescribed online on the government websites. An application can be filed to change your name on Aadhar Card online along with the prescribed fees and submitting the relevant documents.
