Can I register a company name if someone else has been using for an unregistered company?

In an LLP, Private Limited Company and Public Limited Company registration is mandatory. So using the name of an unregistered company also vastly depends upon the kind of Company. A company can be both registered and unregistered but if you use the same name it possesses, it ceases to exist as a separate legal entity. Hence the same name cannot be used by another company.
